What Happens When You Try To Swallow Evidence During A Traffic Stop

On July 31st, officers from the Charlotte County Sheriff’s Office attempted to pull over a gray GMC Yukon for speeding and a seatbelt violation. What began as a routine traffic stop quickly escalated when the driver, later identified as Michael Murphy, refused to stop immediately. The following bodycam footage and police report reveal a suspect attempting to dispose of evidence while evading law enforcement.

According to the Charlotte County Sheriff’s Office, deputies observed a gray GMC Yukon traveling 52 mph in a 45 mph zone. Additionally, the driver was not wearing a seatbelt. Officers activated their emergency lights to initiate a traffic stop, but Murphy continued driving for nearly half a mile before finally pulling over. Upon approaching the vehicle, officers noticed suspicious behavior, prompting them to demand that Murphy open his mouth and spit out any substances he might have swallowed.

Bodycam footage captures officers questioning Murphy about his actions. He admitted to attempting to roll a joint while driving but denied swallowing anything illegal. However, officers suspected he had ingested evidence to avoid detection. Murphy’s erratic behavior and conflicting statements raised further suspicion, leading officers to conduct a vehicle search. Inside, they discovered a small child’s motorcycle along with several knives and machetes, raising additional concerns.

Further investigation revealed that Murphy was a convicted felon, making his possession of weapons illegal. Additionally, officers found marijuana and drug paraphernalia inside the vehicle. Murphy was taken into custody and charged with failure to stop for law enforcement, possession of a weapon by a convicted felon, and possession of marijuana with drug paraphernalia. The search also uncovered a large sum of cash, which Murphy claimed was related to his business but added another layer of scrutiny to the case.

Legal Note:
Possession of a firearm or weapon by a convicted felon is a serious offense under Florida law, often leading to severe legal consequences. Additionally, evading law enforcement, even for a short distance, can result in criminal charges. Drivers should always comply with officers’ instructions and avoid attempting to dispose of evidence, as doing so may lead to additional charges. If facing similar legal issues, it is advisable to consult with an attorney to understand one’s rights and legal options.
